Welcome to PhotoAI.me! These Terms of Service (“Terms”) govern your access to and use of the PhotoAI.me website (“Site”) and services offered by SIA PhotoAI (“we”, “us”, or “our”), Registration No. 40203706305, Legal address: Mārupe, Saules iela 7-1, LV-2167, Latvia. Please read these Terms carefully before accessing or using our Site or services.

By accessing or using our Site or services, you agree to be bound by these Terms, along with our Privacy Policy. If you do not agree with these Terms or our Privacy Policy, you must not access or use our Site or services.

Our Site and services are available only to individuals who are at least 18 years of age. By accessing or using our Site or services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract.

To use our services, you may be required to create an account on our Site. You agree to provide accurate and complete information during the account registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account or any other breach of security.

PhotoAI.me is a web-based Software as a Service (SaaS) platform that enables users to generate AI-generated photos, videos, and motion effects. Users can choose from various photo packages, video effects, and motion effects available as one-time purchases and/or subscription plans. By submitting photos in accordance with our upload guidelines, users will receive AI-generated media. Details regarding available packages, subscription plans, pricing, and upload guidelines are available on our Site.

AI models, effects, features, and generation capabilities may change over time. We may add, modify, replace, or discontinue specific AI models, effects, or features at our discretion without prior notice.

By using our Site and services, you may submit photos and other content (“User Content”) to us. You retain ownership of your User Content, but by submitting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and use your User Content solely in connection with generating and delivering the requested AI outputs to you.

You remain solely responsible for ensuring that you have all necessary rights, permissions, and consents to upload photos and generate AI content using those photos.

You strictly represent and warrant that:

a. You are uploading photos of yourself, OR you have obtained explicit, legally binding consent from any third-party individual whose likeness appears in the User Content.

b. You will not submit any User Content depicting children or individuals under the age of 18.

c. You will not submit User Content that violates applicable laws, infringes on third-party intellectual property or privacy rights, or contains obscene, pornographic, or defamatory material.

d. You are solely responsible for ensuring that your use of PhotoAI.me and any generated content complies with applicable laws in your jurisdiction.

e. We may reject, suspend, or remove generation requests that violate these Terms, applicable law, or our safety policies.

We reserve the right to remove or refuse any User Content or AI generation at our discretion.

All AI-generated photos provided by our Site are generated using proprietary AI algorithms and workflows. Subject to your full compliance with these Terms and payment of applicable fees, SIA PhotoAI grants you a perpetual, worldwide, non-exclusive, royalty-free license to download, use, reproduce, display, and distribute your AI-generated photos for both personal and commercial purposes unless otherwise required by applicable law or third-party AI model licensing terms.

To get the best AI photos, please follow these guidelines:

a. Upload photos of yourself. Preferably clear, close-up photos with good lighting.

b. Make sure there’s only one person in the photo.

c. Variation is key! Use pictures from different days, environments, and poses.

d. Ensure your photos are of good quality and not blurry.

e. Don’t upload the same picture multiple times.

f. Don’t cover your face or wear heavy accessories obstructing facial features.

g. Make sure your face and features are fully visible.

h. Children’s photos are strictly prohibited. Only adult photos are allowed on the platform.

All content, features, software, algorithms, logos, and functionality on our Site and services are the exclusive property of SIA PhotoAI or its licensors and are protected by international copyright, trademark, and other intellectual property laws. You agree not to reverse-engineer, decompile, copy, or attempt to extract the underlying source code or workflows of our Site or services.

You agree to use our Site and services only for lawful purposes and in accordance with these Terms. You expressly agree NOT to:

a. Engage in any conduct that may harm, disrupt, or exploit our Site, services, or other users.

b. Use our Site or services to generate non-consensual imagery, deepfakes, harassment, or deceptive content impersonating real individuals without authorization.

c. Attempt to alter, tamper with, remove, obscure, or circumvent any embedded C2PA Content Credentials, machine-readable metadata, or steganographic digital watermarks incorporated into generated files pursuant to Article 50 of the EU AI Act.

d. Use automated scrapers, bots, or extraction scripts to access or harvest data from our Site or services.

e. Use our Site or services to create or distribute illegal content, including child sexual abuse material, terrorist content, fraudulent content, or content intended to facilitate criminal activity.

f. Use our Site or services to generate content intended to deceive the public, impersonate public officials, or interfere with elections or democratic processes.

Violations of this policy may result in immediate termination of your access to our Site and services without refund.

In compliance with Article 50 of the European Union AI Act, output files generated by PhotoAI.me contain machine-readable metadata and digital identifiers (including C2PA credentials and steganographic watermarks) indicating that the content was created or modified using artificial intelligence. You acknowledge that these indicators are legally required and agree not to tamper with them.

AI-generated outputs are created automatically using artificial intelligence: Generated content may:

- contain inaccuracies;

- differ from uploaded persons;

- include unexpected artifacts;

- not meet user expectations.

Users remain solely responsible for reviewing generated content before publishing, distributing or relying upon it.

We offer refunds and credit adjustments under specific conditions, including technical generation failures and duplicate charges. Detailed eligibility requirements, subscription cancellation rules, and refund procedures for photo packages, subscription plans, and coins are set forth in our Refund Policy, which is incorporated into these Terms by reference. For refund requests, please contact hello@photoai.me within 14 days of the charge.

By selecting a photo package or subscription plan and providing payment information, you agree to pay the fees associated with your chosen plan. All payments are processed through secure third-party payment processors. We reserve the right to change our pricing, subscription plan options, features, and payment terms at any time.

15.1. Subscribing

Upon subscribing to the Service, your payment method will be charged immediately. A subscription grants you access to create AI photos based on your plan limits.

15.2. Payment Methods

We accept supported payment methods displayed during checkout. We do not accept cash or physical checks.

15.3. Recurring Payment

By subscribing, you authorize SIA PhotoAI or its designated payment processor to charge the applicable recurring monthly or yearly subscription fees to your payment method. Unless canceled prior to the renewal date, your subscription will automatically renew at the end of each billing cycle. If prices increase, we will notify you at your registered email address at least fourteen (14) days prior to renewal.

15.4. Billing Date

Your payment method will be charged on your regular billing date based on your subscription cycle.

15.5. Invoicing

An invoice is issued on the billing date for each charge made. Applied taxes (including VAT) depend on your country of residence, determined via checkout information and IP session data.

15.6. Late Payments

If a payment is declined or past due, your subscription may be deactivated. We will attempt to charge your payment method every three (3) days; after three (3) failed attempts, your subscription will be canceled.

15.7. Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to the Service until the end of your current paid billing period.

Our Site and services are designed to work with modern browsers and stable internet connections. We are not responsible for performance issues arising from incompatible devices or connection instability on the user's end.

We respect the intellectual property and likeness rights of others. In accordance with the Digital Millennium Copyright Act (DMCA) and applicable EU directives, if you believe your copyrighted work or personal likeness has been processed or generated without authorization, please notify us at hello@photoai.me with:

a. A description of the copyrighted work or personal image claimed to be infringed.

b. The specific generation ID, asset link, or location of the infringing material on our Site.

c. Your contact information (name, address, phone number, email).

d. A statement made under penalty of perjury that you are the rights holder or authorized to act on their behalf.

We will review and purge valid infringing media within 48 hours.

In no event shall SIA PhotoAI, its officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill arising out of or in connection with your use of our Site, services, or AI-generated outputs.

Our Site and services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that our Site will be uninterrupted, error-free, secure, or free of harmful components.

You agree to indemnify, defend, and hold harmless SIA PhotoAI, its officers, directors, employees, and agents from any claims, liabilities, losses, damages, or expenses (including legal fees) arising out of your violation of these Terms, your User Content, or your infringement of any third-party rights.

These Terms and any disputes arising out of them shall be governed by and construed in accordance with the laws of the Republic of Latvia. You agree to submit to the exclusive jurisdiction of the courts located in Latvia.

Any disputes arising out of or in connection with these Terms shall first be addressed through good-faith negotiations. If unresolved within thirty (30) days, either party may submit the dispute to binding arbitration or the courts of the Republic of Latvia.

Your privacy is important to us. Please review our Privacy Policy, which governs how we collect, process, and protect your personal and biometric data.

Our Site may contain links to third-party services. SIA PhotoAI assumes no responsibility for the content, policies, or practices of any third-party websites or services.

We reserve the right to modify these Terms at any time. Updates will be posted on our Site with a revised effective date. Continued use of our Site or services after updates constitutes acceptance of the changes.

We reserve the right to terminate or suspend your access to our Site and services without prior notice if you violate these Terms or engage in illegal activities.

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, along with our Privacy Policy, constitute the entire agreement between you and SIA PhotoAI regarding your use of our Site and services.
